The Canadian Jetsetter name, logo, and related marks are trademarks of The Canadian Jetsetter and may not be used in connection with any product or service that is not ours, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits us. All other trademarks not owned by The Canadian Jetsetter that appear on this Site are the property of their respective owners.

Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and make personal, non-commercial use of the Services. This license does not include any resale or commercial use of the Services or their contents; any collection and use of any product listings, descriptions, or prices; any derivative use of the Services or their contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools.

This license is revocable at any time without notice and with or without cause.

Reviews, Comments, Emails, and Other Content

Visitors may submit reviews, comments, and other content; send emails and other communications; and submit suggestions, ideas, comments, questions, or other information, so long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties, and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of "spam."

If you submit content to us, you grant The Canadian Jetsetter a non-exclusive, royalty-free, perpetual, irrevocable, and fully sub-licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media. You also grant The Canadian Jetsetter the right to use the name you submit in connection with such content.

Prohibited Uses

You agree not to use the Services for any unlawful purpose or in any way that could harm, disable, overburden, or impair the Site. Prohibited uses include:

• Violating any applicable local, provincial, national, or international law or regulation
• Scraping, crawling, or using automated tools to collect content or data from the Site without our express written consent

We reserve the right to establish general practices and limits concerning use of the Services, including without limitation the maximum period of time that data or content will be retained by the Services and the maximum storage space allotted on our systems. We have no responsibility or liability for the deletion or failure to store any data or content maintained or transmitted by the Services.

We reserve the right, but have no obligation, to monitor use of the Site and the content submitted to the Site. We may disclose any information necessary to satisfy any law, regulation, or governmental request, or to operate the Services properly, or to protect ourselves or our users. Aggregate Analysis

We may compile and use aggregate, anonymized information and statistics derived from your use of the Services for our internal business purposes, including to improve and develop our Services, conduct research, and measure overall performance. We may, from time to time, perform maintenance on the Site or Services that may result in interrupted service, slower response times, or errors. The Canadian Jetsetter may display, include, or make available content from third parties ("Third Party Content") or provide links to third-party websites or services. We do not control, endorse, or adopt any Third Party Content and make no representations or warranties of any kind regarding such content, including its accuracy or completeness.

Flight prices, availability, and deal information change frequently. All deals communicated through our Services are sourced in good faith but we cannot guarantee availability at the time you attempt to book. You acknowledge and agree that The Canadian Jetsetter is not responsible for any transactions between you and any third-party airline, hotel, or service provider.

Insecurity of Internet

You acknowledge that the Internet is not a secure medium and that privacy cannot be ensured. Internet email is not encrypted and is subject to interception. We will not be responsible for any damages you or others may suffer as a result of the loss of confidentiality of information you provide us over the Internet. By using the Site and Services, you acknowledge and accept the inherent security risks of sending information over the Internet and agree that we shall not be held responsible for such risks.

Limitation of Liability, Release and Indemnity

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL THE CANADIAN JETSETTER, ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SERVICES.

You agree to indemnify, defend, and hold harmless The Canadian Jetsetter and its officers, directors, employees, agents, and third-party service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services.

Purchases and Payment

We may offer paid subscription products, including Jetsetter Economy, Jetsetter Premium, and other services. All purchases are processed through secure third-party payment processors. By submitting payment information, you represent that you are authorized to use the designated payment method.

Subscription fees are billed in advance on a recurring basis as set out at the time of purchase. All prices are in Canadian dollars (CAD) unless otherwise stated and are exclusive of applicable taxes. We reserve the right to change pricing at any time, with notice to active subscribers.

Shipping of Products and Risk of Loss

Where physical products are sold through the Site, title and risk of loss for such products pass to you upon our delivery to the carrier. We are not responsible for delays or losses in transit once a product has been handed to the carrier. For digital products and subscription services, access is granted upon successful payment confirmation and no physical shipping applies.

Returns and Refunds

Subscription services may be cancelled at any time. Where a free trial period is offered, no charge will be made during the trial. If you cancel during a paid subscription period, you will retain access until the end of the current billing period. We do not offer prorated refunds for partial subscription periods unless required by applicable law.

If you believe you have been charged in error, please contact us promptly at the email address below. Refund requests are reviewed on a case-by-case basis.

Conflict of Laws

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without giving effect to any principles of conflicts of law. You agree that any dispute arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts located in Ontario, Canada.

Site Policies, Modification, and Severability

We reserve the right to make changes to the Site, these Terms, and any of our policies at any time. If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. Our failure to enforce any right or provision in these Terms will not constitute a waiver of such right or provision.

Force Majeure

We shall not be liable for any failure or delay in performance under these Terms which is caused by circumstances beyond our reasonable control, including but not limited to acts of God, fire, flood, earthquake, pandemic, war, terrorist attacks, government actions, labour disputes, power outages, internet service disruptions, or failures of third-party service providers.

Termination

We reserve the right to suspend or terminate your access to the Services at any time, with or without cause and with or without notice, effective immediately. Upon termination, your right to use the Services will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Miscellaneous

These Terms constitute the entire agreement between you and The Canadian Jetsetter regarding your use of the Services and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning their subject matter. No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. We may assign these Terms without restriction.
